Layla Care Inc. is committed to protecting your privacy. The purpose of this Privacy Policy is to inform you about our privacy practices, including how we collect, use, disclose, and safeguard your personal information when you use Layla’s services, platform, and website. 

  1.   Scope of this Policy

Layla provides supportive services, tools, and processes to enable access to and coordination of mental health supports (the “Layla Services”). The Layla Services may include intake, matching, care coordination, referral triage, scheduling, wraparound supports, and education and resource delivery. The Layla Services may evolve over time. This Privacy Policy applies to all personal information collected in connection with our provision of the Layla Services and your use of our website (www.layla.care).

As part of the Layla Services, we may connect you with regulated health professionals (“Clinicians”) who deliver psychotherapy, psychology, social work, case management, and other regulated mental health services (the “Clinical Services”). 

This Privacy Policy does not apply to personal information that is collected by Clinicians in connection with their provision of the Clinical Services, such as therapy session notes and clinical observations. Layla may handle certain personal information on behalf of Clinicians to assist in their provision of the Clinical Services, however, Clinicians remain responsible for all personal information that they collect, use or disclose in the course of providing such services. If you have an existing relationship with a Clinician, please contact that Clinician to understand their privacy policies and practices. 

  1. Collection of Personal Information

“Personal information” means any information that can be used to identify you directly (on its own) or indirectly (in combination with other information).

Layla may collect different types of personal information, depending on our relationship with you. Generally, the personal information we collect includes the following types of personal information:

  • Contact and Demographic Information, such as your name, address, date of birth, email, phone number, gender and/or pronouns, employment status.
  • Payment Information, such as insurance details, credit card and banking information, health coverage eligibility.
  • Health Information, such as your medical and mental health history, previous care providers, diagnoses, medications, referral notes, substitute decision-makers, and health card numbers.
  • Service Information, such as details about your appointment history, care coordination records, client preferences for therapy and services, platform usage, communication preferences, and feedback you provide to us.
  • Technical Data, such as your browser type, IP address, page views, and user activity collected via Layla’s website or digital tools.

We may collect this information from:

  • You directly 
  • Clinicians or other healthcare providers (e.g. your family physician)
  • Third parties (e.g. insurers, schools, referral agencies)
  • Your use of Layla’s website and digital tools

  1. Use of Personal Information

Layla may use personal information to provide you with the Layla Services. This may include:

  • Coordinating access to Clinical Services
  • Matching clients with appropriate Clinicians
  • Facilitating and administering your use of our website and digital tools
  • Communicating with you or your healthcare providers
  • Ensuring quality oversight, including by evaluating the Layla Services and Clinical Services to maintain or improve their quality
  • Managing our business and arrangements with Clinicians, including to detect and prevent errors and fraud
  • Responding to your inquiries, complaints or requests 
  • Fulfilling our legal or regulatory requirements and protecting our rights
  • Responding to health or safety emergencies
  • Researching, developing and improving our operations, products, services, and platform

We may also use your personal information for such other purposes as you may consent to, and as otherwise required or permitted by law. We may also use your personal information, as permitted by applicable privacy laws, to generate de-identified or aggregated information. We use de-identified or aggregated information for internal research, product development, quality improvement, business planning, and to help improve mental health care. We may also share de-identified or aggregated information with third parties, such as academic collaborators and commercial partners, for these purposes.

  1. Marketing Communications

You may receive occasional communications from Layla related to services, updates, or educational materials. You can unsubscribe from promotional communications at any time using the opt-out mechanism in the message or by contacting us using the contact information below.

If you opt out from receiving promotional communications, we may still need to send you communications about your use of the Layla Services or other matters.

We may use anonymized or aggregated data to support audience engagement strategies, but we do not share identifying personal information with third parties for their independent marketing use.

  1. Disclosure of Personal Information

We generally identify to whom, and for what purposes, we will disclose your personal information at the time we collect your personal information. For example, we may disclose your personal information:

  • To Clinicians, to determine whether you will be matched with the Clinician, and if so, to provide you with Clinical Services
  • To other healthcare providers who are involved in your care, to facilitate the provision of care 
  • To your insurance provider or third-party payor to facilitate payments

We may also disclose your personal information where we believe such disclosure is required or permitted by law. For example, we may disclose your personal information:

  • To government bodies or legal authorities to comply with valid legal requirements such as a law, regulation, search warrant, subpoena, court order, or other legal process 
  • To a third party in the event of a business transaction, such as a merger or reorganization
  • To your emergency contact or other third parties, to protect health or safety in an emergency

Layla relies on third-party service providers to perform a variety of services on our behalf, including data storage and infrastructure providers, practice management software tools, accountants and professional advisors, payment card processors, and technical support providers. These service providers may access personal information only as necessary to provide their services, and are contractually bound to maintain the confidentiality and security of personal information.

  1. Your Consent

We may collect, use, and disclose your personal information with your consent. How we obtain your consent, including whether it is express or implied, will depend on the circumstances and the sensitivity of the personal information in question. Generally, we will seek your consent at the time we collect your personal information, either orally, electronically, or in writing.

If you provide personal information about another individual to us, it is your responsibility to obtain the consent of that individual to enable us to collect, use and disclose their information as described in this Privacy Policy.  

If you wish to withdraw your consent to our collection, use or disclosure of your personal information, please contact us using the contact information below. We will accommodate your request to withdraw consent, to the extent required by law.. Withdrawal of your consent may mean that we will no longer be able to provide you with certain products or services, including the Layla Services.

In certain circumstances, we may collect, use, and disclose your personal information without your consent to the extent permitted or required by law.

  1. Retention of Personal Information

Layla generally retains personal information only as long as necessary to fulfill the purposes for which it was collected, or for a longer period where permitted or required by law.

Clinicians may retain records relating to your receipt of Clinical Services, such as clinical session notes or treatment records, for a longer period of time, as required or permitted by law and health regulatory guidelines. If you have questions about your Clinician’s retention of your health records, please reach out to your Clinician directly. Layla can help connect you with your Clinician. 

  1. Safeguards and Storage

Layla uses physical, technical, and organizational safeguards in an effort to protect your information, including:

  • Encryption
  • Multi-factor authentication
  • Role-based access controls
  • Secure servers and platforms
  • Monitoring and audit trails

Despite these measures, we cannot guarantee that our safeguards will always be effective. A breach of security safeguards can result in risks such as phishing and identity theft. We will address such breaches as required by law. 

We may also require that you assist us in safeguarding your personal information. For example, if you create an account through our platform, you should use a unique and strong password and not share your password with others.

You have the right to:

  • Request access to the personal information we hold about you
  • Request corrections to inaccurate or incomplete personal information we hold about you
  • Ask questions or raise concerns about how your personal information has been used or disclosed
  • Withdraw consent, to the extent permitted by law

We may require that you provide sufficient identification to fulfill your request. We will not charge you any fees to access your personal information in our records without first providing you with an estimate of the approximate fees, if any. 

If you are seeking access to your health records, including clinical session notes or treatment records, please note that Clinicians are the custodians of those records. Layla can help connect you with your Clinician to make such a request.

  1. Children and Substitute Decision-Makers

Layla provides services to minors. In cases where a minor is capable of consenting, we may obtain consent from the minor, or through their parent or legal guardian. In cases where a minor is not capable of consenting, we obtain consent from their parent or legal guardian. We may also obtain consent from an individual’s substitute decision-maker, in accordance with applicable laws.

  1. Use of Cookies and Website Information

A “cookie” is a small text file that contains information and is stored on your computer. We generally use cookies and similar tracking technologies to automatically collect information about your use of our website and platform. Information we collect may include your IP address (or proxy server), device and application identification numbers, location, browser type, internet service provider or mobile carrier, pages viewed, searches, operating system and system configuration information, and time stamps associated with your usage. We use this information to facilitate the use of our website, understand user behavior and improve website performance. 

We may also use this information to engage in interest-based advertising (also known as targeted or behavioral advertising) in connection with your use of our website, and across third-party websites or service offerings when you leave our website. Interest-based advertising means that your preferences and interests are collected through cookies or similar technologies and then used to provide you with advertising and marketing materials that are relevant to you, based on those preferences and interests. For example, we may use Meta Pixel to provide you with advertising based on your browsing history and search requests.

Google Analytics 

Our website uses Google Analytics, a service from Google LLC that uses cookies. The information collected by the cookies (which includes your IP address) is transferred to Google and processed by Google in the United States. Google uses the information to provide us with an analysis of website traffic and use. You can opt out of Google Analytics by downloading and utilizing the Google Analytics Opt-out Browser Add-on. By using our website, you understand and acknowledge our use of Google Analytics.

Layla may provide links to third-party websites for your convenience and information. We may also make opportunities available to you to purchase, subscribe to, or use other products or services from third parties with different privacy practices. Those other websites, products, or services are governed by the privacy statements and policies of the respective third party. This Privacy Policy does not extend to any websites, products, or services provided by third parties. We do not assume responsibility for the privacy practices of third parties not acting on our behalf and we encourage you to review all third-party privacy statements prior to using third-party websites, products, or services.

  1. Cross-Border Data Transfers

While we strive to store all personal information in Canada, some of our service providers may process personal information in other jurisdictions. While your personal information is outside of Canada, it may be subject to the laws of the jurisdiction in which it is located. Those laws may require disclosure of your personal information to authorities in that country. The Privacy Policy was last revised as of the date that appears at the top of this page.
